The land or building is on lease from the land or building owner. Under Thai law the longest period is 30 years, but you can have contractual extensions after that period. The risk is that once the lease expires you can’t use the right to occupancy and ownership of the land or building that is under the leasehold. The lease must be registered with the Land Department.
The property is owned outright by the owner. As a foreign buyer you can own a freehold property in a condominium development. Our real estate agency is also specialised in luxury condominiums located in Koh Samui.
You can be a shareholder of a Thai Company and that company can own the freehold of the land and building. There are more complexities, however, Samui Exclusive is experienced with such procedure and it a common route for foreigners to purchase property in Thailand.
